1. Acceptance of Terms

By accessing or using the Termite Protect website (termiteprotect.com), you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. If you do not agree with any part of these terms, you are prohibited from using this website and must discontinue use immediately.

2. Description of Service

Termite Protect is a website where property owners can purchase and manage an Ever-Shield Sentricon® termite protection plan (Gold or Platinum) for their property. Please note that while Termite Protect offers the plans and handles enrollment and billing, the physical performance of termite inspections, chemical treatments, Sentricon® system installations, and the fulfillment of retreatment and repair warranties are provided exclusively by our service partner, HonorGuard Pest Management, a licensed Structural Pest Control company.

3. Eligibility and Authorized Use

The Ever-Shield plans are designed for property owners. By creating an account or purchasing a plan, you represent and warrant that you are at least 18 years old, that you own the property you enroll (or are authorized by the owner to enroll it), and that you have the legal authority to make service decisions for that property.

4. User Responsibilities and Account Security

You agree to:

Provide accurate, current, and complete information when you purchase a plan and enroll your property.
Maintain the confidentiality of your account credentials and notify us promptly of any unauthorized use of your account.
Provide reasonable access to your property so that inspections, Sentricon® installation, and annual maintenance can be performed.
Promptly update your information, including a change of ownership when you sell your property.

5. Plans, Billing and Cancellation

Plan options, prices, sign-up fees, and billing choices (billed once a year or billed monthly, including any free-trial month) are shown on the website and at checkout, and you agree to pay the amounts shown at the time you place your order. Plans carry a one-year minimum term; after the first 12 months you may cancel at any time. You authorize us to charge your selected payment method for the amounts due, including renewals, through our third-party payment processors. If you believe you have been charged in error, contact us promptly at the email address below.

6. Disclaimer of Warranties

The Termite Protect website is provided on an "as is" and "as available" basis. We make no representations or warranties of any kind, express or implied, regarding the website's operation or the information contained therein. All specific termite treatment results and warranty obligations (including the retreatment warranty on the Gold plan and the structural repair warranty on the Platinum plan) are governed by the plan terms and the separate service agreement between HonorGuard Pest Management and the property owner.

7. Limitation of Liability

To the fullest extent permitted by law, Termite Protect, its affiliates, and its partners shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of profits or data, arising from your use of this website, or from the performance or failure of termite treatments provided by HonorGuard Pest Management.

8. Intellectual Property Rights

All content, branding, logos, and software on this website are the exclusive property of Termite Protect or its licensors. Unauthorized use, reproduction, or distribution of this intellectual property is strictly prohibited.

9. Termination of Access

We reserve the right to suspend or terminate your account and access to the website if we believe you have breached these Terms and Conditions or engaged in unauthorized activity.

10. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law provisions. Any disputes arising hereunder shall be subject to the exclusive jurisdiction of the state and federal courts located in Georgia.

11. Modifications to Terms

We reserve the right to modify or replace these Terms and Conditions at any time. We will indicate the "Last updated" date at the top of this document. Your continued use of the website following any changes constitutes your acceptance of the new terms.
